Learned Special Officer submits that, in terms of the order dated November 4, 2024, the Engineer appointed by the Madhyamgram Municipality inspected the premises on November 25, 2024. The Engineer has submitted a plan for construction of the drainage system; however, the construction work could not commence as the petitioner failed to deposit the estimated cost for such construction.

The petitioner does not dispute the fact that the estimated cost has not been deposited. Learned advocate appearing for the petitioner submits that the petitioner is not in a position to deposit the estimated cost of approximately Rupees One Lakh Fifty-Eight Thousand Eight Hundred Three only (Rs. 1,58,803/-) owing to his poor financial condition.

In view of the aforesaid facts, it is difficult to hold that there has been any violation of the order dated November 4, 2024, by the alleged contemnor. Accordingly, the contempt application being CPAN 1485 of 2025 is dismissed.

Dismissal of the contempt application, however, shall not preclude the petitioner from seeking modification of the order dated November 4, 2024, in accordance with law.

The Special Officer is discharged, with special thanks of this Court.
