Learned advocate appearing for the petitioner submits that the subject matter of the case relates to recovery of 80 bottles of phensedyl. Petitioner is in custody for nine months and till date charges have not been framed. Prosecution intends to rely upon 25 witnesses to prove its case, as such the petitioner would be languishing in jail. Petitioner prays for bail on any stringent condition.

Mr. Nandy, learned advocate appearing for the State has submitted the report which reflects that the CFSL expert's opinion which was earlier called for pursuant to the direction of this Court has been made available before this Court. I have taken into account the quantum of seizure which has been effected and the period of detention of the petitioner

and is of the opinion that further detention of the petitioner is unwarranted in the facts and circumstances of this case. As such the prayer for bail of the petitioner is allowed. Petitioner namely, Jahangir Kabir @ Kanfora Jahangir shall furnish bond of Rs. 20,000/- (Rupees Twenty Thousand only), with two sureties of Rs. 10,000 (Rupees Ten Thousand only) each, one of whom must be local to the satisfaction of the learned Special Judge, under NDPS Act, Berhampore, Murshidabad.

If on bail, the petitioner shall be physically present on each and every date before the learned trial Court in seisin of the case. The petitioner shall not leave the jurisdiction of district of Murshidabad without the prior permission of the learned Special Court.

Accordingly, CRM (NDPS) No. 1084 of 2025 is allowed. Report submitted by the State be kept with the record. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
