The present revisional application was preferred challenging the proceedings arising out of Bidhannagar North P.S. 257 of 1999 dated 30.09.1999.
The petitioner challenged the charge-sheet which was filed in connection with the investigation of the said case. Subsequently, when the revisional application appeared on 14th February, 2022, a report was called for from the Officer-inCharge of Bidhannagar North Police Station. Mr. Debjani Sahu, learned advocate appearing for the State has submitted a report prepared by the Inspector-in-Charge Bidhannagar North Police Station.
Let the report be kept with the record.
Report reflects that after filing of the revisional application, the trial court proceeded and framed charges on 25th February, 2019 and thereafter the trial is pending awaiting order of the High Court.
I find that there is no interim order for a considerable
period of time. As such, there is no reason for the trial court to stall the proceedings.
In view of the change of circumstances, I direct the learned trial court to proceed with the trial of the case and take the same to its logical conclusion. No interference is called for at this stage.
Accordingly, CRR 2718 of 2017 is dismissed.
Pending application, if any, is consequently disposed of. Interim order, if any, is hereby vacated.
