Ahammad Hossain v. State Of West Bengal And ORS.
03.09.2025 W.P.A. 20205 of 2025 Item No.49 Ct. No.35 dc.
Ahammad Hossain versus The State of West Bengal & Ors.
Mr. Rishabh Ahmad Khan ... For the Petitioner.
Mr. Jayanta Samanta, Mr. Keshab Chandra Das ... For the State.
Petitioner complains that after his employment was protected pursuant to the directions passed by the Hon'ble Supreme Court in Writ Petition (Civil) Diary No(s). 38860/2024, petitioner while attending the school has been facing inconveniences and is feeling insecure as he has been subjected to physical harassment. To that effect, information was furnished to the police authorities.
Records of the writ petition reflect that two criminal cases being Illambazar P.S. Case No. 211 of 2024 dated 27.08.2024 (initiated by de facto complainant Musaraf Hossain) and Illambazar P.S. Case No. 213 of 2024 dated 29.08.2024 (initiated by de facto complainant Sk. Firoj) were registered for investigation.
Since case and counter-case have been initiated, prima facie, I find that there is a dispute existing. Petitioner feels insecure while going to school. In case further information is furnished to the police authorities, police authorities would ensure that petitioner, while on the way to his
school, is not faced with further inconvenience and may attend the school for performing his duties. Prompt action, if required, be taken by the local police authorities.
With the aforesaid observations, the writ petition being WPA 20205 of 2025 is disposed of. There will be no order as to costs.
All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.
Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
