Learned Counsel for the petitioner submits he is not the principal accused and uncontroverted materials did not show that he is involved in the crime.

We have considered the materials on record. Trial has commenced and examination of PW 1 is in progress. Under such circumstances, as of examination of witnesses has commenced in a case of gang rape we are not inclined to interfere with the proceeding in exercise of inherent powers. It is open to the petitioner to canvas his defence in the course of trial.

Accordingly, the application is disposed of.
