This application under Article 227 of the Constitution of India is at the instance of the defendant praying for a direction upon the learned Civil Judge (Sr. Divn.), 3rd Court at Barasat to dispose of the Title Suit No. 298 of 2022 expeditiously. The learned advocate appearing for the petitioner submits that the suit is pending from the year 2022.

In view of the order sought and proposed to be passed, there is no necessity to direct issuance of any notice upon the opposite parties. However, the learned advocate-on-record of the petitioner shall be obliged to forward a copy of this application along with this order, upon the opposite parties or upon the learned advocate representing the opposite parties before the learned Trial Judge.

From the order-sheets appended to this application this Court finds that September 8, 2025 has been fixed for service return and acknowledgement due card.

In view thereof this Court is not inclined to interfere with the order impugned.

Accordingly, C.O. 3192 of 2025 stands disposed of.

It will be open to the petitioner to take appropriate steps before the learned Trial Judge. Needless to mention that the learned Trial Judge shall make an endeavour to dispose of the suit being Title Suit No.298 of 2022, as expeditiously as possible after the same is made ready for hearing.
