This application under Article 227 of the Constitution of India is at the instance of the defendant challenging the order dated July 5, 2025, passed by the learned civil Judge (Junior Division), Kakdwip, South 24-Parganas in T.S. No. 210 of 2025. By the order impugned the prayer for ad-interim order of injunction on an application under Order 39 Rule 1 and 2 of the Code in T.S. No.210 of 2025 stood allowed. The order being an appellable order under Order 43 Rule 1(r) of the Code of Civil Procedure, this Court is not inclined to entertain the civil revision application.

Faced with such situation, the learned advocate appearing for the petitioner prays for leave to withdraw the civil revision application with liberty to approach the appropriate forum.

In the light of the submission made by learned advocate for the petitioner, C.O. 3193 of 2025 stands

dismissed as withdrawn with liberty to the petitioner to approach the appropriate forum, in accordance with law.

The learned advocate-on-record for the petitioner shall be permitted to take back the original certified copy of the order impugned by replacing the same with a Photostat copy thereof.
