The petitioner being an accused in connection with G.R. Case No. 270 (01) of 2019 under Section 306 of the IPC has filed the instant revision assailing an order dated 14.7.2022 passed by the learned Trial Judge directing the Investigating Office to execute Warrant of Arrest pending against him fixing 7.9.2022 for execution record. It is submitted by the learned advocate for the petitioner that the petitioner will surrender before the Trial Court on a date fixed by this Court and in the meantime, Warrant of Arrest issued by the Trial Court may be stayed.

Considering the averment in the instant revision and submission made by the learned advocate for the petitioner, this Court is of the view that the instant revision may be disposed of here and now with the assistance of the learned advocate appearing for the State of West Bengal. Accordingly, Mr. Saibal Bapuli, learned Additional Public Prosecutor with Mr. Anami Bhattacharya, learned advocate is requested to assist this Court. The appointments of Mr. Saibal Bapuli and Mr.

Anami Bhattacharya be regularized by the learned Legal Remembrancer, Government of West Bengal.

It is submitted by Mr. Bapuli that when the petitioner wants to surrender before the Trial Court voluntarily, he may be provided a chance and execution of a Warrant of Arrest may be suspended for a short period of time.

On the basis of such submission, the instant revision is disposed of directing the petitioner to surrender before the Trial Court any date before 30.9.2022.

Execution of Warrant of Arrest be suspended till 5.11.2022. The instant revision is thus disposed of.

The learned Trial Judge is requested to act upon the server copy of this order.
