Seen the written note of the Superintendent of 'SR' Section.

In the said report, the department has mentioned that the appeal was barred by limitation, for which an application for condonation of delay under Section 5 of 'Limitation Act' was filed by the appellant, which was registered as CAN 02/22.

In the said report it is also mentioned that the said application for condonation of delay was dismissed by the Hon'ble Court vide order dated 16.05.25. Therefore, in such circumstances, the department has placed this record for passing a formal order of dismissal.

Considering the aforesaid fact, I am of the view that the fact of the dismissal of application of condonation of delay is the dismissal of the appeal and as such the formal order of dismissal of the appeal is recorded.
