Report submitted by the learned advocate appearing for the State be kept with the record. Petitioners have approached this Court claiming ownership. On the other hand, police report reflects that the private respondent no.5 asserts possession and ownership. Petitioners have already approached the learned Executive Magistrate.

Learned advocate appearing for the private respondent no.5 submits that earlier a writ petition on selfsame set of facts has been dismissed by a coordinate Bench of this Hon'ble Court.

Police report reflects that a proceeding has been drawn up under Section 126 of BNSS.

Since the police authorities are already in know-how of the prevailing situation between the petitioners and the private respondent as also the nature of circumstances existing at the locality, I am of the view that police authorities would continue their surveillance and ensure that no breach of the peace takes place.

With the aforesaid observations, the writ petition being WPA 20411 of 2025 is disposed of. There will be no order as to costs.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
