Mr. Kalyan Chatterjee Ms. Sudeshna Mondal ... for the petitioner. This is an application wherein petitioner has prayed for expeditious disposal of BGR Case No. 4377 of 2008 arising out of Kasba Police Station Case No. 285 of 2008 under section 341/186/353/34 of the Indian Penal Code.

It is submitted on behalf of the petitioner that the said proceeding is pending for about last 18 years and the evidence of the prosecution has not yet started and as such he prayed for necessary direction upon the court below for expeditious disposal of the said proceeding.

Having heard learned counsel for the petitioner it appears that the prayer made by the petitioner is innocuous and if any order is passed in terms of the prayer made in the petition opposite parties will have no cause to prejudice, as such, service of copy of application upon the opposite parties is dispensed with. Since the prayer made on behalf of the petitioner is justified in terms of the long pendency of the case the court below is directed to make every endeavour for expeditious disposal of the case and to make its best effort to conclude the trial preferably within a period of six months from the next date of hearing and if possible by making day to day hearing of the trial without giving any unnecessary adjournments to either of the parties. This order

is passed invoking this court's jurisdiction under section 529 of the BNSS.

On the basis of the prayer made by the petitioner liberty is given to the petitioner to make a prayer before the court below for delivery of judgment of the instant proceeding being BGR Case No. 4377 of 2008 with A.C. Case No. 2072 of 2008, which is allegedly the cross suit and in the event of making such prayer by the petitioner before the court below, the court below will dispose of his prayer without being influenced by any observation made herein.
