For the State Learned counsel for the petitioner submits that the petitioner is in custody for 53 days and prays for bail. The petitioner is not aware as to how his mobile phone was utilised for making fraudulent transactions of huge sum of money through RTGS. He is not the beneficiary to the said amount.

Learned counsel for the State opposes the prayer. I have considered the material on record.

The petitioner's mobile phone was used in impersonating the managing director of a company and sending messages to the executive of Haldia Water Services Private Limited pursuant to which an amount of Rs.1,98,00,000/-was transferred through RTGS from the bank account of the company to various beneficiaries. The investigation is in progress. Mobile phone has been seized from the petitioner.

Considering the nature of the offence and prima facie involvement of the petitioner therein, prayer for bail is rejected at this stage.

The application for bail is disposed of.
