Mr. Anjan Bhattacharyya ...for the petitioner Dr. Sutanu Kumar Patra Ms. Supriya Dubey ...for the WBCSSC Writ petition is finally heard in presence of the learned advocates representing the petitioner and the West Bengal Central School Service Commission. In terms of the order dated 21st June, 2024 a report in the form of affidavit has been filed on behalf of the Commission today and the same is taken on record. On perusal of the report specially paragraph 5 (c) it appears that the petitioner could not secure the requisite percentage of marks in higher secondary examination being a reserved category candidate. It has been averred in the said paragraph that the requisite percentage of marks a reserved category candidate is required to obtain in higher secondary examination is 40% whereas petitioner secured 39.7%.

Though petitioner has made an attempt to make out a case that by supersession below ranked candidates in the merit list were favoured with employment but the

reason for not treating the petitioner as an eligible candidate today during course of hearing cannot be disputed on behalf of the petitioner.

In view of the aforesaid fact that the petitioner could not secure requisite percentage of marks in higher secondary examination being a reserved category candidate no relief can be granted in this writ petition in favour of the petitioner.

Accordingly, the writ petition stands dismissed. However, there shall be no order as to costs. Urgent photostat certified copy of the order, if applied for, be given to the parties, upon usual undertakings.
