For the State The petitioner is directed to serve a copy of this revisional application upon Mr. Koushik Kundu, Learned Advocate, who ordinarily appears on behalf of the State. His appearance may be regularised by the concerned authority. Learned Advocate for the petitioner submits that Mathurapur P.S. Case No. 212 of 2017 was registered for investigation on 15.8.2017. Subsequently, charge-sheet was submitted before the learned jurisdictional Court. Charge have already been framed by the Learned Judicial Magistrate, 2nd Court, Diamond Harbour, in connection with the said case.
The prosecution in order to prove its case has relied upon eight witnesses but till date none of the witnesses have been examined and the next date has been fixed on 27th of June, 2024.
Having considered the stretch of time, after which the present case has been initiated, I direct that the Learned Judicial Magistrate, 2nd Court, Diamond Harbour, would on and from 27th of June, 2024 fix one date in a month for the purposes of the present case so that the trial of the case can be taken to its logical conclusion within a reasonable period of time.
The Learned Public Prosecutor conducting the case would produce the materials, documents, exhibits on the next date so fixed for examination of the witnesses. The concerned SDPO, Diamond Harbour would act as a Nodal Officer of the case. In case, any communication is made, he would ensure regarding the witness being produced before the Learned Court on the next date so fixed.
All efforts be taken by all the stakeholders so that the trial is completed at the earliest.
With the aforesaid observations, CRR 3144 of 2023 is disposed of.
Pending application, if any, is also disposed of. Parties to act on a server copy of this order duly collected from the official website of the Hon'ble High Court at Calcutta.
