... for the added respondent In re:- CAN 3 of 2025 This is an application for appropriate order. Mr. Habibur Rahman, learned counsel for the added respondent submits that the petitioner of this writ petition namely Raj Mohammad had expired on 23rd September, 2024.

He submits that no application for substitution was filed by any of the heirs of the deceased petitioner. The instant writ petition has been abated.

Ms. Sonam Ray, learned counsel appearing for the petitioner submits that she has no instruction in that matter.

In CAN 3 of 2025, death certificate of the petitioner is annexed. It appears from the copy of the death certificate that the petitioner was expired on 23rd September, 2024. The Sub-Registrar (Birth & Death), Gram Panchayat Domohona had issued the said death certificate on 14th October, 2024. Since no application for substitution was filed by on or before the legal representative of the petitioner and as the statutory

period for substitution is over, the instant writ petition has already been abated.

Accordingly, the writ petition is hereby disposed of as abated.

Consequently, interim order, if any, passed by this Court during the pendency of the writ petition, is also vacated.

CAN 3 of is disposed of, connected applications, if any, also stands disposed of. (Subhendu Samanta, J.)
