The appeal is directed against an order dated 22nd July, 2025 passed by a Single Bench of this Court.

The grievance of the appellants/writ petitioners before the Single Bench was that a tender was floated in the year 2022 and in gross violation of all rules and principles, tender was awarded to the private respondent.

The appellant/petitioner appears to have been sleeping until 2025. It is submitted by the private respondent and the Municipality that

not only was the tender being awarded to the private respondent but work thereunder has also been completed. The writ petition filed in the year 2025 of a tender process started in the year 2022 is therefore, hopelessly belated and bad for principle of delay and laches.

Since the tender has not only been awarded to the private respondent but work thereunder has also been completed, any cause of action of the appellant/writ petitioner to challenge the tender process and the award of the contract thereunder stood extinguished.

In that view of the matter, MAT 1430 of 2025 shall stand dismissed.

Consequently, all connected applications, if any, shall also stand dismissed.

Interim orders, if any, shall stand vacated.

8.

There shall be no order as to costs.

9.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
