Report submitted by Sub-Divisional Police Officer, Tehatta, Krishnagar Police District reflects that the death report was submitted before the jurisdictional court on 5th April, 2022. Let the same be kept with the record.
Unnecessarily, the main case is pending before the learned ACJM, Tehatta. If the case till date has not been committed, learned ACJM, Tehatta will take steps for committing the case to the concerned sessions court for further progress of the case. Needless to state the case was initiated in the year 2011, more than 12 years have passed for reasons which have contributed to the delay. Learned sessions court, as such, on receipt of the records, would take utmost efforts for consideration of the charges and if the sessions court is of the opinion that the charges are to be framed and trial to be progressed, in that case, the learned sessions court would proceed with the trial of the case by fixing at least a
schedule of three dates once in a month so that the trial of the case can be taken to its logical conclusion within a reasonable period of time.
With the aforesaid observations, CRR 3396 of 2022 is disposed of.
Pending application, if any, is consequently disposed of. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
