For respondent nos. 8 & 9 Mr. Manoranjan Maity ... for addition of party Learned advocate appearing for the petitioners submits that the petitioners are in possession of a two-storied building and have made an application before the Panchayat seeking permission for construction of an additional (third) floor. The Panchayat, in turn, referred the matter to the Zilla Parishad. The petitioners also applied before the Zilla Parishad for approval of the construction of the additional floor; however, no steps have been taken by the Zilla Parishad for approval of the building plan. Learned advocate appearing for the Zilla Parishad submits that the petitioners had submitted an online application and that the same can be considered only upon submission of an offline application in the usual course, along with payment of the requisite fees.

Mr. Manoranjan Jana, learned advocate, seeks to intervene in the matter on behalf of one Prakash Maity by filing CAN 1 of 2025. It is submitted that the entire building of the petitioners, up to the third floor, is unauthorized and that a demolition order has already been passed by the Panchayat in respect of the said construction. On that basis, it is contended that no sanction should be granted by the Zilla Parishad.

In view of the aforesaid facts and circumstances, I am of the view that the present writ petition need not be kept pending.

Accordingly, the Zilla Parishad is directed to consider the petitioners' application in accordance with law, after affording an opportunity of hearing to Mr. Prakash Maity. Mr. Prakash Maity shall be at liberty to produce all relevant documents before the Zilla Parishad. After granting an opportunity of hearing to both Mr.

Prakash Maity and the petitioners, the Zilla Parishad shall take a reasoned decision within a period of three months from the date of filing of the offline application by the petitioners.

Accordingly, WPA 20396 of 2025, along with CAN 1 of 2025, is disposed of.
