1. Liberty is granted to the petitioners to correct the description of the petitioner no.1 in the cause title.

2. This is a billing dispute as the petitioners contend that the West Bengal State Electricity Distribution Company Limited has raised a bill contrary to the regulations. At the relevant point of time, the cold storage was undergoing renovation and thus the calculation was exorbitant. It is submitted that a representation is pending before the authority.

3. Mr. Srijan Nayak, learned Advocate for the electricity distribution company submits that the authority themselves miscalculated the quantum payable on account of consumption charges. Due to such mistake, the revision was made in the calculation and the amount was claimed. It is submitted that more than Rs.12 lakhs is payable.

4. Under such circumstances, the petitioner's grievance must be decided by the Regional Grievance Redressal Officer, WBSEDCL, North 24 Parganas. The writ petition shall be forwarded by the distribution company and the petitioner to the said officer for disposal and the matter shall be disposed of upon hearing all the parties. As there is a fault on the part of the authority in recording the correct data as per the energy consumption, no coercive measure shall be taken until the matter is decided by the authority. Parties will abide by the decision of the authority. The calculation shall be made in accordance with the decision of the authority. As this is a question of unpaid dues, the decision shall be taken by the authority within two months from receipt of the documents.

5. A copy of the writ petition along with server copy of the order be served upon the Regional Grievance Redressal Officer, North 24 Pargans within a week by the petitioner as also the distribution company.

6. The supplementary affidavit is taken on record.

7. Accordingly, the writ petition is disposed of.

8. All parties are directed to act on the basis of the server copy of the order.
