For the Applicants Mr. Rabindra Narayan Dutta Mr. Hare Krishna Halder ...for the State The contempt application has arisen out of the order dated 10th April, 2017 since it has been alleged on behalf of the applicant that there is violation of the direction as contained in the said order dated 10th April, 2017.

Today, the learned advocate representing the applicant and alleged contemnor have jointly submitted that an order was passed by the Hon'ble Division Bench dated 1st April, 2024 on an intra Court appeal being MAT 339 of 2023 thereby the order passed by the coordinate Bench on 10th April, 2017 stood modified. The order dated 1st April, 2024 passed by the Hon'ble Division Bench is taken on record.

Having considered the submissions made on behalf of the learned advocates representing the parties it appears that the order passed by the coordinate Bench

on 10th April, 2017 merged with the order dated 1st April, 2024. Therefore, the contempt application is not maintainable.

Accordingly, the contempt application stands disposed of.

Urgent photostat certified copy of the order, if applied for, be given to the parties, upon usual undertakings.
