The instant application under Article 227 of the Constitution of India is at the instance of the defendants in a suit for declaration and is directed against Order No.19 dated May 18, 2024 passed by the 2nd Court of the learned Civil Judge (Junior Division), District : Paschim Medinipur in the said suit being Title Suit No. 437 of 2019.

The learned Trial Judge for the repeated failure of the defendants, by the order impugned has closed their evidence and has put the suit for ex parte argument.

The defendants were afforded opportunity to adduce evidence on several occasions from March, 2021 to July 2023 but they were reluctant to avail such opportunity, therefore, the order impugned does not call for any interference.

C.O. 2983 of 2024 is thus dismissed without any order as to costs.
