This is an joint application filed both the parties before this Court. Since compromise settlement has been effected between the parties the petitioner is not willing to proceed with this matter. Pursuant to the direction by the Coordinate Bench on December 1st, 2025 the parties were directed to appear personally or virtually and State was directed to file conforming settlement between the parties.

Pursuant to such direction a report was filed on behalf of the prosecution where the settlement of the defacto-complainant was also recorded and the decree of mutual divorce has been passed on 3rd September, 2025 by the learned District Judge, Purba Medinipur.

Learned advocate appearing on behalf of the State hand over the statement recorded by the present petitioner by the concerned Officer of Purba Medinipur.

Two separate affidavits have filed on behalf of both the parties confirming said settlement.

In view of the above facts and circumstances and in view of the averment made in the joint compromise petition recording their settlement arrived at and also that a decree of mutual divorce has been passed on 3rd September, 2025, this Court is of the view there is no reason to allow the proceeding to continue as the same would be sheer abuse of the process of law. Hence prayer stands allowed. 6.

The instant criminal revisional application being 3835 of 2025 is disposed of, with the above observation. 7.

The proceeding pending before the learned Court of Additional Sessions Judge, 5th Court, Purba Medinipur is hereby quashed.

In view of the above the application being CRAN 1 of 2025 stands disposed of.

Parties are to act on the server copy of this order downloaded from the official website of the Calcutta High Court. 10.

Let a copy of this order be sent to the concerned Court for taking necessary steps.
