The petitioners have preferred the present writ petition seeking the direction upon the respondent authorities for refund of the security deposit retained in respect of a work which is alleged to have been completed by them under the Bidhannagar Municipal Corporation.

It is the case of the petitioners that a work order was issued on 11.03.2022 vide Memo No. 1108/PWD(BMC) by the Executive Engineer, PWD, Bidhannagar Municipal Corporation. In terms of the said work order, the petitioners claim to have completed the assigned work to the full satisfaction of the authorities in May, 2022. However, they have not yet received the security deposit which continues to lie with the Accounts Department of the respondent-Bidhannagar Municipal Corporation. The petitioners have made several representations before the concerned authorities, but the same have not been acted upon. The petitioners further submit that they have received the payment for completion of the work. Their only grievance is the non-refund of the security deposit which has been lying with the Bidhannagar Municipal Corporation, has not been released till date.

Learned counsel for the respondent-Bidhannagar Municipal Corporation submits that the authorities are ready and willing to consider and dispose of the representation of the petitioners dated 12.08.2024.

In light of the above submission, learned counsel for the petitioners submits that the petitioners would be satisfied if their representation dated 12.08.2024 is considered and decided by the Corporation in a time-bound manner.

Accordingly, this Court directs the Commissioner, Bidhannagar Municipal Corporation (respondent no.2), to consider and decide the representation of the petitioners dated 12.08.2024 by passing a reasoned and speaking order, strictly in accordance with law, within a period of eight weeks from the date of communication of this order. Prior to the passing of such order, the said authority shall afford an opportunity of personal hearing to the petitioners.

With the aforesaid directions, the present writ petition is disposed of.

Since no affidavits have been filed by the respondents, the allegations made in the writ petition shall not be deemed to have been admitted.

There shall be no order as to costs.
