For the State It is submitted on behalf of the petitioners that the State respondents have utilised a portion of their land for extension of Barasat Bypass Road and are intending to utilise other portions of their land without acquisition.

State Authorities filed a report dated 17th October, 2019 which indicates that the plots belonging to the petitioners have not been acquired in any land acquisition proceeding. The petitioners seek liberty to submit a representation before the concerned Authority ventilating their grievance and pray for a direction upon the concerned Authority to consider such representation at the earliest.

Having considered the submissions made on behalf of the parties and material on record, the writ petition is disposed of with

liberty to the petitioners to submit a representation in this regard before the 4th respondent within a period of fortnight from date. The 4th respondent is directed to consider and dispose of the said representation within three months from the date of receipt of the same after granting reasonable opportunity of hearing to all the interested parties including the petitioners, in accordance with law. W.P.A. 18888 of 2019 is thus disposed of.

There shall be no order as to costs.

Since no affidavit has been invited, allegations contained in the writ petition shall be deemed not to have been admitted. Urgent certified website copy of the order, if applied for, be given to the parties on compliance of requisite formalities. (Suvra Ghosh, J.)
