IN Re: CRAN 1 of 2024 1.

The petitioner was granted bail by an order dated September 8, 2023 passed in CRM (DB) 3318 of 2023, inter alia, on the conditions that he shall not leave the municipal limits of city of Kolkata except for the purpose of attending court proceedings and shall report to the officer in charge of Bhowanipore Police Station once in a week until further orders. The petitioner now seeks relaxation of the aforesaid two conditions of bail. He says that he has been adhering to all the conditions of bail. 2.

From the report filed by the State, we do not find anything adverse about this petitioner. He seems to be adhering to the bail conditions scrupulously. Let the report be kept with the records. 3.

We further note that there has not been much progress in the trial. Only 1 out of 81 charge sheet named witnesses has been examined. There is absolutely no possibility of early conclusion of the trial.

In view of the aforesaid, we are inclined to allow the petitioner's prayer. Hence, the petitioner is allowed to leave the municipal limits of city of Kolkata. Further, the requirement of the petitioner reporting to the officer in charge of the Bhowanipore Police Station, once every week stands dispensed with. All other conditions of bail remain unaltered.

CRAN 1 of 2024 is, thus, disposed of.
