Heard learned counsels for the parties.

The petitioner complains that though his land has never been acquired or utilized by the State respondents, the men and agents of the State respondents are disturbing his possession therein.

It is submitted by the State respondents and also reflected in the report issued by the Assistant Land Acquisition Officer, Hooghly on 18th November, 2021 (Page 24 of the writ petition) that the plot in question being No.1680 of Mouza-Saidpur, P.S. Pursurah is raiyati land. In view of the above, nothing further remains to be adjudicated in the present writ petition.

However, the State respondents are at liberty to take recourse to law for the purpose of acquisition of the land in the event it is required for public purpose.

With the above observations and directions this writ petition being WPA 21431 of 2021 is disposed of. However, there shall be no order as to costs.

Since no affidavit is invited, the allegations contained in the petition are deemed not to be admitted. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
