The inspection report of Berhampore Municipality signed by the engineers of the Municipality on January 2, 2023 has been placed before this Court. The same is taken on record.

It appears therefrom that the petitioner remained absent at the time of inspection. The report reveals that the septic tank of the private respondent was properly constructed within the boundary of four feet space. There is no violation of the municipal laws at the time of construction of the septic tank. There is no crack visible on the walls of the petitioner due to the construction of the septic tank.

It appears from the inspection report that none of the allegations of the petitioner has been found to be true.

In view of the above, no relief can be granted to the petitioner in the present writ petition.

The writ petition fails and is hereby dismissed. Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
