Halder, Mr. Indranil Halder .... for the petitioner Ms. Sumouli Sarkar .... for the CESC Limited It is fairly pointed out by learned counsel for the petitioner that the petitioner's wife had previously approached this court with a writ petition bearing WPA No. 6999 of 2022, which was disposed of on May 19, 2022 and similar orders should govern the present writ petition as well.

Heard learned counsel for the parties.

The premise of the instant writ petition is that the petitioner's application for new electricity connection was refused by the CESC Limited on the ground of splitting of load and imminent danger and risk if a second connection is given at the premises. Since the writ petition itself has been filed, just as WPA No. 6999 of 2022, beyond ninety days from the cause of action, it would not be appropriate to

refer the matter to the concerned Grievance Redressal Officer.

However, in the event the petitioner has an independent right of getting electricity connection from the landlord/owner of the premises, it will be open to the petitioner to approach the appropriate forum for getting such relief.

Accordingly, WPA No. 20728 of 2022 is disposed of in the light of the above observations.

There will be no order as to costs.

Urgent photostat certified copies of this order, if applied for, be made available to the parties upon compliance with the requisite formalities.
