These two applications under Article 227 of the Constitution of India are taken up together for analogous consideration and disposal since they are arising out of two proceedings for grant of letters of administration being heard by the learned Trial Judge analogously.
The opposite party no.1 has applied for grant of letters of administration of the alleged last will and testament of one Yeshwant Chopra. The petitioner, the daughter of the said testator, objected to the said prayer for the grant, as a result, the proceeding has become contentious being Original Case No.8 of 2022 pending before the learned Judge, 2nd Bench, City Civil Court at Calcutta.
The opposite party no.1 has also applied for grant of letters of administration of the widow of the said Yeshwant Chopra, namely, Satya Rani Chopra. The said proceeding has also become contentious on the objection being raised by the petitioner. The said proceeding being O.C. No.9 of 2022 is also pending before the learned Judge, 2nd Bench, City Civil Court at Calcutta and the learned Trial Judge is hearing both the cases analogously.
The petitioner is complaining delay in disposal of the said proceedings and is praying for a direction for expeditious disposal of those proceedings.
It appears from the record that the learned Trial Judge has fixed October 7, 2024 for the peremptory hearing of the said proceedings.
The proceedings are pending since 2018; the learned Trial Judge is requested to bring the said proceedings to its logical conclusion as expeditiously as possible and in doing so shall not grant any unnecessary adjournment to either of the parties.
CO 2991 of 2024 and CO 2993 of 2024 are disposed of with the above observations without any order as to costs. Parties to act on the server copy of this order duly downloaded from the official website of this Court. Urgent Photostat certified copies of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
