Report submitted by the learned advocate appearing for the State be kept with the record. Records reflect that on 07.10.2024 when the writ petition was called, none appeared on behalf of the petitioner. Today also when the writ petition has been called, none represents the petitioner. Petitioner being aggrieved by the inaction of the police authorities approached this Court as pursuant to the directions passed by the civil court, no steps were taken.

State has submitted a report which reflects that T.S. No. 1217 of 2023 is pending before the learned Civil Judge (Junior Division), 6th Court, Alipore. There is a long standing land dispute between the petitioner and the private respondents. Police authorities are aware regarding the same. However, the police authorities drew up proceedings under Sections 126/137(3) of BNSS. Having considered that the police authorities have knowledge regarding the nature of dispute, I am of the view that the steps taken by the police authorities are in adherence to the provisions of

law. In case the petitioner is faced with fresh inconveniences, petitioner would approach the jurisdictional civil court for breach of any order so passed. Learned civil court will pass necessary directions as it deems fit and proper.

With the aforesaid observations, the writ petition being WPA 21037 of 2024 is disposed of. Pending connected application, if any, is consequently disposed of.

There will be no order as to costs.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.
