The writ petitioners are aggrieved by the eligibility criteria in a Notice Inviting Tender published by the West Bengal State Warehousing Corporation for providing manpower as multipurpose worker cum weighbridge operator having requisite qualifications at warehouses managed by WBSWC. The petitioners participated in the tender process but were unsuccessful.

By a communication dated 5th November, 2021, the petitioners raised several grievances on the eligibility criteria prescribed in the tender. The said representation was replied to by a communication dated 29th November, 2021 issued by the West Bengal State Warehousing Corporation.

It is now well settled that a person, who participates in a tender process, cannot normally turn around and challenge the terms and conditions thereof.

This Court, therefore, does not find any merit in this writ petition.

Hence, the instant writ petition shall stand disposed of without any order.

There will be no order as to costs.
