Though the petitioner has sought for expeditious disposal of Money Suit No. 292 of 2015 pending before the learned 6th Bench, City Civil Court, Calcutta, but the learned advocate appearing for the petitioner, frankly submits that an application for referring the matter to mediation, filed by the opposite party/defendant, on 18th September, 2019 has not yet been disposed of.

It is thus submitted that petitioner/plaintiff has no objection if the pending matter is sent to mediation or by any other means, so as to explore the possibility of settlement between the parties. In view of the nature of the order proposed to be made in the case, no prior notice is considered to be necessary.

Service upon the opposite party is thus dispensed with.

Accordingly, learned 6th Bench, City Civil Court, Calcutta in Money Suit No. 292 of 2015 is requested

to ensure expeditious disposal of the application filed by the defendant, on 18th September, 2019 seeking a reference to mediation, or by any other means for settlement outside the Court, providing sufficient opportunity of hearing to either of the parties to this case, but without granting unnecessary adjournment, preferably within three weeks after reopening of Puja vacation of the Court below.

Petitioner is directed to make communication of this order to the learned court below as well as to the learned advocate appearing in the court below for the opposite party and the opposite party.

With this observation and direction, the revisional application stands disposed of.

Urgent photostat certified copy of the order, if applied for, be given to the parties on usual undertakings.
