The petitioner is aggrieved by the alleged inaction on the part of the Tamluk Police Station in investigation into Tamluk Police Station Case No.193/2022 dated 16.03.2022 under Sections 323/326/379/354B/420/ 406/506/120B/34 of the Indian Penal Code.

FIR was registered pursuant to the orders under Section 156(3) of the Code of Criminal Procedure. Counsel for the State submits that one person has been arrested and is in judicial custody and anticipatory bail petitions of two other persons have been rejected by this Court.

There are warrants of arrest pending and proclamation and attachment orders have also been obtained.

Counsel for the respondent no. 6 & 7 submits that his client filed an application for anticipatory bail before the Supreme Court which is since pending. Be that as it may, since the petitioner submits that the accused persons are roaming around in the locality, he may inform the Tamluk Police Station immediately upon the accused being sighted and the warrant of arrest shall be executed forthwith. Since the petitioner and his wife feel seriously threatened and intimidated by the private respondents, Tamluk Police shall arrange for necessary security for the petitioner for a period of two weeks from date. The investigation into the FIR should be completed as expeditiously as possible with the available accused person.

With the aforesaid directions, the writ petition is disposed of.

There shall be no order as to costs.

The instructions of the Inspector-in-Charge, Tamluk Police Station, Purba Medinipur dated 19.07.2022 is taken on record.
