Affidavit-of-service filed on behalf of the petitioner is taken on record.

Pursuant to the previous order dated 21st June, 2024 matter is taken up for consideration when no one appears on behalf of Dhola High School (H.S.), District-South 24 Parganas in spite of service of notice.

On perusal of page 17 of the writ petition, it appears that the transfer on the ground of distance has been rejected by the aforesaid school authority on adopting resolution dated 21st February, 2022. The learned advocate representing the concerned District Inspector of Schools has placed before this Court the copy of the Managing Committee Resolution dated 21st February, 2022 and copy of the same has also been made over to

the learned advocate representing the petitioner. Since no challenge has been thrown to the Managing Committee Resolution dated 21st February, 2022 relief as prayed for in this writ petition cannot be granted.

Accordingly, the writ petition stands dismissed.

However, this order shall not preclude the petitioner to take steps in accordance with law against the Managing Committee Resolution dated 21st February, 2022 There shall be no order as to costs.

Urgent photostat certified copy of this order, if applied for, be given to the learned Advocates for the parties on the usual undertakings.
