Affidavit of service filed by the petitioner is taken on record.

The petitioner is the handicapped dependent son of the deceased school teacher, who seeks to be granted with the family pension after death of his father on February 9, 2016.

To that effect, he has submitted a representation before the respondent/District Inspector of Schools (SE), Howrah. The said representation is pending as yet.

Hence, Ms.

Khutia(Bhunya),learned advocate appearing for the petitioner seeks an order that the respondent be directed to immediately consider the same.

Mr. Mondal, learned advocate has appeared for the respondent State. He has raised strong objection as to the genuineness of the prayer of the petitioner for the reasons, inter alia, that the disability certificate of the petitioner has been issued much after the date of death of his father and that the petitioner has not substantiated with

material facts his dependency upon the deceased school teacher.

Having heard the learned counsels for the respective parties, it is found proper that the respondent no. 4/District Inspector of Schools (SE), Howrah be directed to immediately consider the representation of the writ petitioner dated July 1, 2024 and the other dated Nil, within a period of six weeks from the date of communication of copy of this order.

In doing so, the said respondent shall afford opportunity of hearing to the petitioner and pass a reasoned order if not the prayer of the petitioner is immediately allowed by the same 8.

With the above observations and directions the writ petition being WPA 21064 of 2024 is disposed of.

Since no affidavit is invited, the allegations contained in the petition are deemed to have been denied by the respondents including the private respondents.

10. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
