Ranjit Mitra v. Manoj Kumar Agarwal
CPAN 893 of 2018 With IA No. CAN 1 of 2021 in WPA 3896 of 2018 08.07.
Ct. No. 04 Ab Ranjit Mitra Vs.
Manoj Kumar Agarwal.
--------------- Mr. Kamal Kanta Kar.
... for the applicant.
Mr. Susovan Sengupta, Mr. Subir Pal.
... for the alleged contemnor.
Re: CPAN 893 of 2018.
The instant application for contempt was taken out alleging the willful and deliberate violation of the order dated 12th June 2018 whereby and whereunder the alleged contemnor was directed to consider and dispose of the representation dated 22nd December 2017 within four weeks from the date of communication the order in accordance with law.
The learned Advocate for the alleged contemnor submits that the alleged contemnor has already disposed of the said representation within the time indicated in the said order and the same was also communicated to the petitioner. However, he hands over the photocopy of the order passed by the alleged contemnor in Court today. Since the compliance has already been made, I do not find any justification in the allegations made in the contempt application. The contempt application is, accordingly, dismissed.
However, it is open to the petitioner to take appropriate steps against the said decision, which has been communicated to him in open Court today before
the appropriate forum.
In view of the dismissal of the contempt application, the connected application being CAN 1 of 2021 has become infructuous and the same is also dismissed. (Harish Tandon, J.)
