Nirmal Kumar Nandy The revisional application has been preferred challenging the proceedings relating to case No.C-2723 of 2000 under Section 138 of the N.I. Act pending before the Chief Judicial Magistrate, South 24 Parganas, Alipore.

The stage at which the petitioner approached this court was after Section 251 of the Code of Criminal Procedure was complied with by the Learned Trial Court.

I have perused the contention advanced in the revisional application and I find that mixed question of facts and law are involved as such, I am of the opinion no interference is called for. Accordingly, CRR 3326 of 2009 is dismissed.

All pending connected applications, if any, are consequently disposed of.
