Mr. Anindya Sundar Das Mr. Shaunak Ghosh Ms. Suva Gayen Ms. Kuheli Gayan .....For the Petitioner Ms. Ipsita Bnerjee Mr. Akash Dutta .....For the State The petitioner alleges that no steps have been taken by the police authorities in spite of the fact that the petitioner has lodged complaints vide letters dated 21st November, 2023 and 25th of February, 2024.

The learned advocate for the State files a report of the Officer-in-charge, Charu Market Police Station dated 29th August, 2024 which is taken on record.

It appears from the said report that pursuant to the complaint lodged by the petitioner vide letter dated 21st November, 2023 Charu Market P. S. case no. 132 dated 21.11.23 was registered and after completion of investigation, charge sheet under Section 341/323/506/509/427/379/354 and 114 of the Indian Penal Code has been submitted before the learned Chief Judicial Magistrate, Alipore, South 24 Pgs. against the private respondent nos. 6 to 9 and two others vide charge sheet no. 47 dated 30.07.2024. The said report further states that pursuant to the other complaint dated 25.02.2024 Charu Market P. S. case no.27 was registered against the private respondent nos. 10, 15 to 18 and others and after completion of investigation, charge sheet under Sections 326/323/324/354/380/427/506/34 of the Indian Penal Code has been submitted before the learned

Chief Judicial Magistrate, Alipore, South 24 Pgs. vide Charge sheet no. 52/2024 dated 26.08.2024.

It is therefore evident that the police authorities have taken steps pursuant to the complaint lodged by the petitioner.

Mr. Ghosh, learned advocate appearing for the petitioner submits that the petitioner is being threatened by the private respondents of dire consequences in the event she dares to enter into her own property. However, the learned advocate for the petitioner, in his usual fairness, submits that no complaint in that regard has been submitted before the police authorities. In the event, any such complaint is made before the police authorities, such authority after considering the nature of the complaint shall take steps in accordance with law. While considering the representation permitted to be filed pursuant to this order, the police authority shall also take into consideration the conditions imposed upon the petitioner while she was enlarged on bail on 26th February, 2024 in connection with Charu Market P. S. Case No.26 dated 25.02.2024 under Section 307/34 of the Indian Penal Code.

The writ petition stands disposed of.

There shall be no order as to costs.
