The competent authority of the West Bengal Nursing Council shall dispose of the application for registration filed by the petitioner (Annexure P-7 at page 27 of the writ petition) by taking note of the certificate of registration granted by the Karnataka State Nursing Council.
The petitioner is known as Soma Maji Chowdhury. In the diploma certificate issued by the Karnataka State Diploma in Nursing Examination Board, the petitioner had been inadvertently mentioned as Soma Maji. In other documents, including the certificate of registration of Karnataka State Nursing Council, her name appears as Soma Maji Chowdhury. It also appears that the petitioner has filed an affidavit affirmed before the learned Metropolitan Magistrate
(1st Class) at Calcutta indicating that in the marksheet and the certificate, her name was wrongly recorded as Soma Maji instead of Soma Maji Chowdhury.
The petitioner will produce the original registration certificate granted by the Karnataka State Nursing Council. If it appears that her name is Soma Maji (Chowdhury), in that event provisional registration shall be given to the petitioner in the name of Soma Maji (Chowdhury) which has been given in the certificate of registration of the Karnataka State Nursing Council and the fate of such provisional certificate shall be subject to enquiry from the Karnataka State Nursing Council as to the authenticity of the said certificate dated September 15, 2021 (Annexure P-6 at page 26 of the writ petition). As the petitioner is on the verge of losing her registration on account of long pendency of the registration application before the council, such registration shall be made within a period of one week from date.
With the above observation and direction, the writ petition stands disposed of.
