The present application under Section 439 of the Code of Criminal Procedure has been preferred by the petitioner in connection with Kaliachak Police Station Case No. 58 of 2020 dated 19.01.2020 under Section 6 of the Protection of Children from Sexual Offences Act, 2012.

Heard the learned advocates appearing for the respective parties and considered the materials in the case diary. It appears that the petitioner is in custody for about 750 days. However, most of the witnesses have been examined. Considering the seriousness of the offence and the stage of the proceeding, we are not inclined to exercise any discretion in favour of the petitioner and as such, his prayer for bail is refused at this stage.

However, the learned court below is directed to expedite the trial and conclude the same as early as possible, preferably within

a period of six months from the date of communication of this order.

With the aforesaid observations, the application for bail, being CRM 9042 of 2021 is, thus, disposed of. All parties shall act on the server copies of this order duly downloaded from the official website of this Court. (Sugato Majumdar, J.) (Tapabrata Chakraborty, J.)
