The petitioner claims to be the Mutwalli of a Waqf property situated on L.R. Plot No. 1819, J.L. No. 177, Mouza - Sahachak, District - Paschim Medinipur. The petitioner alleges that respondent no. 8 has undertaken unauthorised construction on the said plot without obtaining permission from the Panchayat Authority.

Learned counsel appearing for the petitioner has referred to a letter dated April 2, 2024, issued by the Chief Executive Officer, Board of Auqaf, West Bengal, directing the Officer-in-Charge, Daspur Police Station, to take necessary steps against the alleged unauthorised construction.

Respondent no. 8 is not represented.

It appears that the petitioner has submitted a representation, as appearing at page 37 of the writ petition, before the Pradhan, 4 No. Sahachak Gram

Panchayat, Daspur-II Block, Paschim Medinipur, respondent no. 6, requesting necessary action against the alleged unauthorised construction.

In view of the above, I am not inclined to keep this writ petition pending.

Accordingly, this writ petition is disposed of with a direction upon the Pradhan to consider the petitioner's representation and, if any unauthorised construction is detected, to take action in terms of Section 23(5) of the West Bengal Panchayat Act, 1973. Accordingly, WPA 21051 of 2024 is disposed of.

Urgent photostat certified copy of this order, if applied for, be supplied to the learned advocates for the parties on usual undertakings.
