Leave granted to the learned advocate for the petitioner to implead the Secretary, West Bengal Board of Primary Education as party respondent in the instant writ petition.

The formality of serving a copy of the writ petition upon the added respondent stands dispensed with as learned advocate has already entered appearance on behalf of the Board.

The petitioner is a primary school teacher. She is a Thalesemia patient and is suffering from gynecological ailments. She seeks transfer on medical

ground. Her application is pending consideration before the West Bengal Board of Primary Education. Without going into the merits of the said application, the writ petition is disposed of by directing the Secretary, West Bengal Board of Primary Education to take into consideration the prayer of the petitioner seeking transfer in accordance with law at the earliest but positively within a period of ninety days from the date of communication of this order. A reasoned order shall be passed and communicated to the petitioner immediately thereafter.

Learned advocate for the petitioner is directed to forward a copy of all documents in support of the prayer for transfer to the aforesaid respondent at the time of communicating the order of the Court. The writ petition stands disposed of.

Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
