Leave granted to the learned advocate on record of the petitioner to implead the Secretary, West Bengal Board of Primary Education as party respondent in the instant writ petition. The formality of serving a copy of the writ petition upon the added respondent stands dispensed with as the Board is represented by the learned advocate.
Leave is also granted to the learned advocate on record of the petitioner to correct the description of the respondent no.4 in the cause title of the writ petition. The proper party will be the Chairman, Purba Bardhaman District Primary School Council.
The petitioner seeks transfer on the ground of illness of the minor daughter of the petitioner. Her application is pending consideration before the Secretary, West Bengal Board of Primary Education. Without entering into the merit of the said application, the instant writ petition is disposed of by directing the Secretary, West Bengal Board of Primary Education to take into consideration the prayer of the petitioner in accordance with law at the earliest but positively within a period of three months from the date of communication of this order. A reasoned order shall be passed and communicated to the petitioner immediately thereafter.
Learned advocate for the petitioner is directed to forward a copy of the representation seeking transfer along with all documents in support of her prayer at the time of communicating the order of the Court. Instruction forwarded by the District Inspector of Schools (PE), Purba Bardhaman signed on 29th August, 2024 be retained with the record.
The writ petition stands disposed of.
