22nd September, (AK) W.P.A 20947 of 2022 Hemanta Paira Vs.

State of West Bengal and others Mr. Bhaskar Chandra Manna ...for the petitioner.

Mr. Mihir Kundu ...for the WBSEDCL.

Mr. Swapan Kr. Pal ...for the State.

The written instruction filed by learned counsel for the WBSEDCL, authored by the Assistant Engineer, EGRA CCC of the WBSEDCL, which states that one connection has been effected permanently (as per tariff class) on and from February 10, 2015 in the agricultural premises of the petitioner vide consumer ID No. 201484234 which is running up to date as per tariff of WBERC following all the formalities, be kept on record. It has also been assured by the WBSEDCL that after this "running season" for agriculture in paddy field they will execute the permanent structure for the said connection.

Such assurance given on behalf of the WBSEDCL leaves nothing further to be adjudicated in the present matter.

The difficulty in constructing a permanent pillar mid-season is understandable, since it may hamper the cultivation of several paddy fields.

Hence, keeping the undertaking filed on behalf of the WBSEDCL dated September 20, 2022 on record, WPA 20947 of 2022 is disposed of by directing the WBSEDCL to provide a permanent structure for the permanent electricity connection to the petitioner's agricultural premises in respect of consumer ID No.201484234 as expeditiously as possible, immediately after the end of the ongoing agricultural season.

Needless to say, in the event any obstruction is raised from any quarter, it will be open to the WBSEDCL personnel to approach the local police station. If so approached, the Inspector-in-Charge of the said police station shall provide adequate police assistance for such purpose at the cost of the petitioner.

There will be no order as to costs.

Urgent photostat copies of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
