Both the learned advocates appearing on behalf of contesting parties in this revisional application are present. Admittedly, all the evidence on behalf of the complainant was recorded and date was fixed for defence witness. In this circumstances, learned advocate appearing for the petitioner submitted that the matter be disposed of with a direction upon the learned trial Court to give liberty to the petitioner to raise all issues raised in this revisional application before the trial Court at the time of argument. From the record it appears that by the order impugned the learned trial Judge refused to discharge the petitioner and that is why this revisional application was filed assailing that order.
Considering the facts and circumstances, especially, the recording of evidence by the Court, I am of the view that the instant revisional application may be disposed of with liberty to the petitioner to raise all issues at the time of argument.
Accordingly, the revisional application, being CRR 2948 of 2018, stands disposed of.
Both parties will act on the order uploaded in the official website of this Court.
