Learned counsel appearing on behalf of the petitioners submits that a false case of murder was earlier foisted against the present petitioners and the father of the petitioner no.1. Taking advantage of the same, the local miscreants being the private respondent nos.5 to 19 looted away fruits from the orchard of the petitioners as also the jewelry and other things. A complaint was made before the police authorities, but was not acted upon.

Learned counsel appearing on behalf of the State denies the allegations and submits that a specific case being Hariharpara Police Station Case No.298 of 2023 dated 14.07.2023 under Sections 379, 427, 506 and 34 of the Penal Code has already been registered in this regard. As a specific FIR has also been registered in respect of the complaint made by the petitioners and is being investigated upon, no further order need be passed in this regard.

Let the investigation be conducted expeditiously and in accordance with law.

With these observations, the writ petition is disposed of. Urgent certified copy of this order may be given to the parties expeditiously, if applied for.
