The writ petition has been listed at the instance of the Bank.

It is submitted that the subject matter of the writ petition was E-auction sale conducted by the Bank of secured assets on account of dues payable by M/s. Shankar Saw Mills Private Limited.

The writ petitioner, aggrieved by E-auction conducted by the Bank, has filed the writ petition. It is now submitted by the Bank that the entire auction sale itself has been cancelled and the earnest money has already been refunded to the highest bidder.

In view of such submissions of the Bank, the writ petition has become infructuous.

The writ petition is, therefore, disposed of without any order.

It is made clear that the Bank may take appropriate steps to put up the secured assets for sale in accordance with law and in terms of the provisions of the SARFAESI Act, 2002 and Rules framed thereunder.

Communication of the Bank dated 30.12.2021 to the writ petitioner, produced by the Bank, along with Bank's intimation dated 04.02.2022 to the highest bidder are kept on record.
