Heard learned counsels for the parties.
Learned counsel for the petitioner submits that the petitioner has been falsely implicated and he is not named in the FIR. He was not present at the place of occurrence at the relevant time. He prays for bail.
Learned counsel for the State opposes the prayer. I have considered the material on record. The petitioner appears to be the master mind who chalked out the entire alleged incident. He has been implicated by independent witnesses. The call detail records between the petitioner and one of the principal assailants immediately prior to the alleged incident prima facie connects him to the alleged incident. The petitioner is in custody for about 170
days. Offence, if proved, shall attract mandatory life imprisonment.
Considering the extent of involvement of the petitioner in the alleged offence, prayer for bail is rejected at this stage. The application for bail is thus disposed of. Case diary be returned.
