Mr. Sumanta Das ... for the petitioner Mr. Washim Ahmed Mr. M. Shehabuddin ... for the State Affidavit of service filed in Court is taken on record. A report filed by the State is also taken on record. Learned advocate appearing for the petitioner submits as follows. The petitioner is a clerk employed at the Krishnanagar Court. On 20.04.2023 at about 9.45 hrs the petitioner went out of his residence. When he returned, he saw that his belongings were rummaged and his almirah and locker were broken. A cash of a sum of Rs.6,45,000/- along with gold ornaments were looted away. The petitioner lodged an FIR being Dhubulia PS Case No.183 dated 21.04.2023 under Section 380 of the Code. However, no articles could be recovered and no arrest could be made by the investigating agency.

Learned advocate appearing on behalf of the State relies on the report and submits as follows. A suspect was arrested from the near place of occurrence, but nothing came out of such arrest. The investigating officer recorded the statement. But, there was no eyewitness or chance witness.

unfortunately there was none. However, the investigation is continuing and an effort is being made for recovery of stolen articles.

I do not find any fault in the manner in which the investigation has progressed.

The investigation shall be concluded expeditiously and in accordance with law.

With these observations, the writ petition is disposed of without any order as to costs.

Urgent certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
