Learned senior counsel appearing on behalf of the petitioners submits as follows. The petitioners are absolutely innocent and in no way connected with the alleged offence. The prime accused is one Chandan Kumar who had allegedly shot the victim. In fact, the present FIR was lodged suo motu by the police. A subsequent complaint made by the victim was not taken on record. Learned counsel appearing on behalf of the State relies on the case diary and opposes the prayer for anticipatory bail. She submits that the subsequent statement given by the victim has also been incorporated in the case diary. The victim received gun shot injury when one Chandan Kumar fire at him. From the statement of

independent local post occurrence witnesses who had gone to the place of occurrence, it appears that he had seen the victim in injured condition being held by the present petitioners while the main accused was standing near.

Learned counsel appearing on behalf of the victim strongly opposes the prayer for anticipatory bail.

Considering the materials available in the case diary, I do not consider this to be a fit case for granting anticipatory bail. Accordingly, the application for anticipatory bail is rejected. The presence of the Investigating Officer is noted and is dispensed with.
